Major Issues in Roman Legal History: Varro, Augustus, and the Spolia Opima


In 29 BCE, M. Licinius Crassus, proconsul of Macedonia and grandson of Julius Caesar’s and Pompey’s notorious associate, boldly claimed the right to dedicate the Spolia Opima to Jupiter Feretrius for having personally slain Deldo, king of the Bastarnae, a powerful Balkan tribe.

This paper examines how Augustus, anxious to prevent Crassus from receiving this unrivalled honour, decided to enlist the unparalleled prestige of the great scholar M. Terentius Varro (116-27 BCE) to bend Rome’s public law and distort its very history to this purpose. The significance of this historic debate on the right to dedicate the Spolia Opima - the armour of a slain chieftain - to Jupiter, will also be discussed.
